These Terms and Conditions ("Terms") govern your access to and use of the website at https://websitedesignshop.co.za (the "Site") and any purchase you make from it. By using the Site or placing an order you agree to these Terms. Please read them carefully. If you do not agree, please do not use the Site.

2. Definitions

"We", "us", "our" and "Website Design Shop" refer to Website Design Shop, a sole proprietorship. "You" and "Customer" refer to the person accessing the Site or placing an order. "Goods" means the products offered for sale on the Site.

3. Eligibility and accounts

You must be at least 18 years old and legally able to enter into a binding contract to purchase from us. You are responsible for keeping your account details and password confidential and for all activity that occurs under your account. Please notify us immediately of any unauthorised use.

4. Products, pricing and availability

All prices are shown in South African Rand (ZAR) and are inclusive of Value-Added Tax (VAT) where applicable, unless stated otherwise. We make every effort to display products, descriptions and stock accurately, but product images are for illustration and packaging or specifications may vary. Stock availability is not guaranteed until your order is confirmed. We reserve the right to correct any errors, inaccuracies or omissions and to change prices, promotions and availability at any time without prior notice. Where a genuine pricing error occurs, we are not obliged to supply Goods at the incorrect price.

5. Orders and formation of contract

Your order is an offer to buy. All orders are subject to acceptance by us and to the availability of stock. A binding contract of sale comes into effect only once we have received payment in full and sent you an order confirmation. We may decline or cancel an order (for example, where stock is unavailable, payment cannot be verified, or a pricing error has occurred), in which case we will refund any amount already paid.

6. Payment

Payments are processed securely through Paystack. We do not store your full card details. By paying, you confirm that you are authorised to use the payment method. Goods remain our property until payment has been received in full.

7. Delivery

We deliver within South Africa. Estimated delivery times are provided at checkout and are estimates only, not guarantees. Risk in the Goods passes to you on delivery. If you are not available to accept delivery, additional charges or delays may apply. Please ensure your delivery address and contact details are correct — we are not responsible for delays or losses caused by incorrect information supplied by you.

8. Cooling-off right (online purchases)

In accordance with section 44 of the Electronic Communications and Transactions Act 25 of 2002 (ECTA), you may cancel an online purchase without reason and without penalty within 7 (seven) days after the date you receive the Goods, and receive a refund of the price paid (less the direct cost of returning the Goods). This right does not apply to certain Goods, such as items unsealed after delivery for reasons of health or hygiene, made-to-order items, and digital or downloadable products. 9. Returns, refunds and defective goods

Your rights in respect of returns, refunds and defective, damaged or incorrect Goods are set out in our Refund & Returns Policy, which forms part of these Terms. Nothing in these Terms limits your rights under the Consumer Protection Act 68 of 2008 (CPA).

10. Warranties

Goods are covered by the implied warranty of quality under the CPA and, where applicable, by the manufacturer's warranty. Warranty periods and conditions vary by product and manufacturer. Warranties do not cover damage caused by misuse, accident, unauthorised repair, or normal wear and tear.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential loss arising from your use of the Site or the Goods. Nothing in these Terms excludes or limits any liability that may not lawfully be excluded or limited, including liability under the CPA.

12. Intellectual property

All content on the Site — including text, graphics, logos, images and software — is owned by or licensed to us and is protected by law. You may not copy, reproduce or distribute any content without our prior written consent.

13. Privacy

We process your personal information in accordance with our Privacy Policy and the Protection of Personal Information Act 4 of 2013 (POPIA).

14. Acceptable use

You agree not to use the Site for any unlawful purpose, to interfere with its operation or security, or to attempt to gain unauthorised access to any part of the Site or its systems.

15. Changes to these Terms

We may update these Terms from time to time. The version published on the Site at the time of your order applies to that order. Please review these Terms periodically.

16. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. Any dispute will be subject to the jurisdiction of the South African courts. You may also refer certain complaints to the National Consumer Commission or the relevant ombud.
